I wouldn't put it in the past tense. In UK we always say it in the present.

Colin is right in that in dialogue we'd say 'It's on the house', but it entirely depends on the context. If they're still in the restaurant, I'd say it in the present tense - otherwise, it's in the past! Hope this helps.

If the question was "Did you pay?", the reply would be "No, it was on the house". If you're still in the restaurant, the question would be "Have you paid?"

I as a person can only be asked if I've paid or did I pay if I'm still there, can't I? Or will someone run after me into the car park and ask: Did you pay? In which case I can still easily answer: It's on the house.
