Context:	Or, la loi peut être inconstitutionnelle et le juge administratif n’est pas juge de la constitutionnalité des lois, mais de la légalité des règlements. Dans ce cas, on dit que la loi (inconstitutionnelle) fait écran entre la Constitution et le règlement, c’est la théorie de l’écran législatif (CE 10 novembre 1950, arrêt fédération nationale d’éclairage et des forces motrices). Dans ce cas, le juge administratif est incompétent.
