My comment:

"probar", according to the Diccionario de Términos Jurídicos by Alcaraz-Varó, means to establish or demonstrate. What is being established are the "grounds" or reasons for bringing the suit.

Consulte el libro de Statsky "Legal Thesaurus/Dictionary" y otros mas y junto con 20 años de experiencia como abogada en mi pais conlcui que si bien podemos traducir "declarar" como "declare" pienso que legalmente "pronounce" es mas acertado por que las resoluciones judiciales tiene sentido definitivo, o sea quien tiene autoridad (el juez) pronuncia una decision basada en las pruebas.
