My comment:

Im Deutschen ist ganz klar, dass es sich um eine zukünftige Maßnahme handelt, auch wenn es ganz korrekt eigentlich heißen müsste: ... werden nicht berücksichtigt werden (aber so korrekt drücken sich nur Deutschlehrer aus).
Der Sinn bei "are not considered" wäre: ... sind nicht berücksichtigt (worden).
Ja: deutsche Sprache - schwere Sprache.
