My comment:

das Verhalten ist nicht etwa beanstandbar (also in der Teorie) sondern es ist bereits (de facto) beanstandet worden!!!!

There are tooooo many ways to word this; what is the exact context?
One might write:
behaviour which has given rise to complaint;
behavious of which complaint is (or has been) made; etc., etc....
according to the EXACT context....
