What is a Curator bonis?

A Curator bonis is a person appointed by the Court to manage the financial affairs of another person who in the opinion of the Court is unable to manage those affairs for himself or herself, or to give adequate directions to others for their management. Such incapacity may result from mental illness, mental defectiveness, brain damage or severe physical handicap. Curators may also be appointed in certain circumstances to children and young persons under the age of majority (16) and to missing persons. A person to whom a Curator bonis is appointed is referred to as a Ward.

DE LA CURATELA EN CASOS DE PRODIGALIDAD

I. PRECEDENTES

En Roma, de acuerdo con la Ley Decenviral, la curatela del pródigo afectaba a aquellas personas con hijos que dilapidasen los bienes heredados abintestato de sus ascendientes (bona paterna avitaque). Era necesaria una declaración formal o prohibición del Magistrado que impide disponer de los bienes (interdicto bonis). La curatela se encomendaba a los agnados más próximos y, en su defecto, a los gentiles.


La jurisprudencia amplió el concepto de la prodigalidad, suprimiendo las limitaciones de la Ley Decenviral (derrochar los bona paterna avitaque y tener hijos), de modo que para que procediese el sometimiento a curatela no hacia falta más presupuesto que la dilapidación. Se puede nombrar curador dativo, e incluso confirmar al nombrado en testamento
