In my opinion, the refernce is to fundamental conditions that are not met, so that an article of the law cannot be invoked.

This is from the Alcaraz-Varó Diccionario de Términos Jurídicos.
I have a copy of the C.R. Código Penal, and in Article 10 it talks about how sentences imposed in foreign courts are applied in Costa Rica.

My comment:

I recently did a translation in which I had to research "presupuestos" and "hypotheticals" is what I came up with. A procedural hypothetical is detailing what would be done in a certain case.
