My comment:

I discussed this term with the judge I work for. He is somewhat bilingual. I explained to him that "declarar con lugar" is the antonym of "declarar sin lugar", which means "to dismiss, to overrule". He said that there is no antonym in English for "dismiss or overrule", so there isn't just one word for "declarar con lugar". What a judge does is deny the defense's motion to dismiss the case, which in essence means to declare the suit worthy of being tried.
