aux torts de d'une des parties (FR) = against one of the parties(EN) est valable pour un jugement .( Dictionnaire juridique English- French . Dalloz.)

mais dans le cadre d'un contrat le sens change:
au détriment de .... ( FR) = to the detriment of (EN). It implies a damage but is not exactly the same for lawyers :). Usually detriment caused to a person place the person in the position of seeking damages

the legal term of "torts" in English is damages and include all kind of damages, not only financial ones

Literally, it means that Company B is automatically at fault. There may be a better way to express that.
